Client, enters into the following agreement with Rosette Photography, hereafter referred to as “Photographer.”
This contract constitutes the entire agreement between both parties and will apply to all future transactions.
A. Session Fee & Retainer Fee:
Client agrees to pay photographer a non-refundable retainer fee of $112.50 at booking, the remaining fee of $112.50 is due at least 7 days before the session, 45 minute Mini Session. Making the total fee of the session $225. These fees cover the time and talent of the photographer, basic retouching and creative editing of images as determined by the photographer and a gallery of images.
B. Location Cost & Travel Fees:
If there are any cost and/or fees associated with the location the client has chosen for their session, you, the client, will be responsible for those fees. The photographer will not guarantee or arrange any payments on any location. This fee will be discussed about before the time of the session and covers travel within 1 hour of your chosen location. Any location outside of these limits will be subject to an additional charge or $.50 per mile as part of the agreement.
C. Cancelation Policy:
If an illness or situation prevents a photo session from taking place, client may reschedule at least 48 hours prior to their scheduled shoot without penalty. Should client fail to give 48 hours’ notice, or decide to completely cancel their shoot, this session fee is forfeited and will not be refunded. Photographer reserves the right to reschedule due to illness, weather, equipment malfunction or other circumstances beyond their control.
D. Photo Archiving:
All images will be available for purchase and/or download for 4 weeks after the gallery has been sent. After 4 weeks, images may be purged from the hard drive and no longer available for access. Photographer may retain certain images for promotional purposes. Photographer is not responsible for storing images beyond the 4-week period.
E. Photography Session Services Payment:
All payments must be paid in full 7 days before the session in order for photos to be taken.
F. Authorship Credit:
Authorship credit in the name of the Photographer (Rosette Photography) with a link to the Photographers domain (www.therosettephotography.com) must accompany any images posted or displayed on any social media.
G. Arrival Time:
a) Please arrive 5-10 minutes before your scheduled session time.
b) If client fails to arrive on time, that time will be docked from the session.
H. Re-shoots / Refunds
Re-shoots are determined at the discretion of the photographer. Re-shoots and refunds will not be given for poor choices of clothing, make-up, hair or weather related issues, child behavior, or by not following the recommendations of the photographer.
I. Editing & Online Gallery:
Rosette Photography wants to insure your satisfaction with the photographs. Editing is a process that takes time. Your online gallery will be ready 4-8 weeks after the session date.
J. Model Release:
Photographer requires clients to sign a model release for the purpose of using images for future marketing purposes or for display in their portfolio whether in print or online.
a) I agree to grant the following rights and permissions to Rosette Photography (Stephanie Rosette) who have the irrevocable, perpetual and unrestricted right and permission to take, use, re-use, publish, and republish photographic portraits or pictures of me/my family or in which I may be included, without restriction as to changes or alterations or reproductions thereof in color or otherwise and in any and all media now or hereafter known.
b) I hereby attest that I have the right to contract in my own name. I have read the above authorization, release, and agreement, prior to its execution and I am fully familiar with the contents of this document. Liability Photographer is not responsible for any damage to person(s) or property during photo session.
c) Client is responsible for their own children and their safety. Client releases Photographer of any and all liability.
K. Copyright & Print Release:
a) Rosette Photography retains all copyrights to all images created during client’s session. A print release will be signed for all digital files to print portraits for personal use, up to designated size listed on print release (8x10).
b) It is illegal to copy, scan, download, print, share or alter any image created by Rosette Photography unless permission has been given in a written form.
c) Indemnification Client agrees to indemnify and hold harmless the Photographer from any claims, losses, fees, attorney fee, cost and judgements against the Photographer that result from acts or omission of the client, clients family members or any acting agent of the client.
d) The images that are being provided to you are licensed copies for any reasonable personal purposes, including but not limited to: printing, copying, emailing, and web publishing (web publishing requires credit given to Rosette Photography (Stephanie Rosette)). Your license does not include use that results in financial gain, including but not limited to: advertising, stock photography, print sale profits, or resale of any nature.
e) Your purchase of the edited files releases Rosette Photography (Stephanie Rosette) from any liability due to loss or damage of the images, and also releases Rosette Photography (Stephanie Rosette) from any obligation to maintain copies of any digital file, image, or photograph.
f) You hereby grant to Rosette Photography (Stephanie Rosette) the right to use and publish images and photographs taken at your photography session to further promote its service, including portfolio, website, display, advertisement, and editorial use.
L. Rosette Photography (Stephanie Rosette) may revoke this license at any time and for any reason. Rosette Photography (Stephanie Rosette) retains all copyrights to the images and derivative works thereof. By using any of these images, you are agreeing to the above terms.
I hereby attest that I have the right to contract in my own name.
